Extended Producer Responsibility (EPR) for E-Waste

What is EPR?
Extended Producer Responsibility is a regulatory principle that makes the producer of an electronic product — the brand owner, manufacturer or importer — legally responsible for what happens to that product once it becomes waste. Instead of e-waste going to landfills or the informal/unorganised sector, producers must ensure a rising share of what they sell each year actually gets collected and recycled through authorised channels.
In India, this is implemented and enforced by the Central Pollution Control Board (CPCB), under rules notified by the Ministry of Environment, Forest and Climate Change (MoEFCC).
Legal framework
E-Waste (Management) Rules, 2016 — first EPR mandate
The first Indian regulation to require EPR for e-waste, under CPCB guidelines. Superseded by the 2022 Rules.
E-Waste (Management) Rules, 2022 — current framework
Notified 2 November 2022, in force from 1 April 2023. Replaced the 2016 rules; introduced yearly EPR targets, a portal-based registration/return system, and the foundation for EPR certificate trading. Amended three times since (Jan 2023, Jul 2023, Mar 2024) — see all of them on our Legal page.
E-Waste (Management) Amendment Rules, 2024
Established the EPR-certificate electronic trading/settlement platform and set the certificate price band under Rule 15(9) — see "EPR certificates" below.
Yearly EPR recycling targets
Each producer's target is a percentage of the e-waste generated from what they placed in the market in a reference year (based on the product's average life), under Schedule III of the 2022 Rules. Newer producers (started selling more recently) have a separate, lower target schedule under Schedule IV.

EPR certificates — how recyclers earn
When an authorised recycler processes e-waste, CPCB credits EPR Certificates to that recycler's portal account, in proportion to the quantity recycled. Producers who haven't met their own collection target buy these certificates to cover the shortfall — creating a tradeable compliance market, separate from the scrap material's own resale value.
- •Certificate price is bounded by Rule 15(9): the ceiling is 100% of the Environmental Compensation (EC) rate and the floor is 30% of it, as fixed periodically by CPCB.
- •Trading happens through CPCB-authorised "Electronic Trading and Settlement Platform" (ETP) operators.
- •Producers who still fall short after buying certificates are liable for Environmental Compensation — a per-kg penalty under CPCB's EC guidelines.
Registration & forms
Producer, recycler, dismantler and refurbisher registration — and the annual EPR return/target filing — all happen on CPCB's own online portal, not as a downloadable PDF form. Typical registration validity is 5 years from the date of issue.
